PURPOSE OF THE CONTRACT
These Terms & Conditions make up the entire contract governing the terms and conditions for the purchase of products made available to Users by LAMU CONCEPT STORE on the Website (the “Products”).
PURCHASE OF PRODUCTS
- How to make an order
To purchase Products, Users must follow the purchase process established on the Website, read and accept these Terms & Conditions and the Privacy Policy , and select “Complete and Pay” (the “Order”). LAMU CONCEPT STORE will then send an email to the User confirming that the Order has been accepted (the “Shipment Confirmation”).
Before placing an order, the user must select the same, being very important to review the characteristics and the final price of the same. The contract between the User and LAMU CONCEPT STORE will be formalised once LAMU CONCEPT STORE sends the User the Shipment Confirmation. The purpose of the contract shall solely cover the Products stated in the Order.
- Formalization of the order
The items that you wish to purchase must be selected and added to the shopping cart by clicking on the corresponding icon. The color and number of units must be chosen desired for each selected item. The shopping cart shows the reference of the chosen item, its name, model, color, units and price, in euros (taxes included). The price expressed does not include the cost of transportation, whose rates vary depending on the selected shipping method and area.
To make the purchase, the user’s personal data will be required if the user is not previously registered. The personal data provided will be incorporated into our database in order to be able to process the order and to facilitate the making of new purchases through the website. The personal data of the users will be treated in accordance with the provisions of our privacy policy. The user will be able to access, at any time, their personal data provided and the information of the orders placed. LAMU CONCEPT STORE reminds users that they must indicate the personal data accurately to avoid confusion or incidents in the delivery of the order and the items purchased.
- Product Delivery
Once the Shipment Confirmation has been sent, the Products will be delivered to the address stated by the User on making the Order, within a period ranging from two (2) to seven (7) days approximately, as from when they leave LAMU CONCEPT STORE.
LAMU CONCEPT STORE does not accept any responsibility or liability where the Product is not delivered because the details supplied by the User are false, incorrect or incomplete, or where the delivery cannot be made through no fault of the shipment company, assigned for these purposes, as may be the case where the User is absent or the Product is held at Customs. Delivery periods are approximate, although LAMU CONCEPT STORE does its utmost to keep to them.
- Availability of Products
All Orders are subject to Product availability. Where a Confirmation has been sent but LAMU CONCEPT STORE is unable for any reason to get hold of the Product requested, LAMU CONCEPT STORE will contact the User as soon as possible to inform them of this. In which case, LAMU CONCEPT STORE may:
Offer the User, without any increase in price, another product with similar features and specifications to the one originally requested, provided these comply with the User’s needs; and/or offer the User to cancel the Order requested and refund the User the amount paid, within a period of (14) working days.
- Refusal to process an Order
While LAMU CONCEPT STORE will do its utmost to always process all Orders, exceptional circumstances may occur that compel it to refuse to process an Order even after it has sent the Shipment Confirmation, for which reason LAMU CONCEPT STORE reserves the right to make such a refusal at any time and at its entire discretion.
LAMU CONCEPT STORE reserves the right to withdraw any Product from the Website at any time and to change any of the Product’s materials or content, without being liable to the User or any third party for withdrawing any Product from the Website, regardless of whether or not that Product has been sold.
- Product Guarantee
It shall be understood that the Products meet the Terms & conditions where they satisfy all the requirements expressed below:
They fit the description given by LAMU CONCEPT STORE and possess the Product qualities that LAMU CONCEPT STORE has presented the User as a sample or model.
They are suitable for the uses that are usually intended for Products of the same type.
They have the usual quality and benefits of a product of the same type which the User can expect, bearing in mind the nature of the product.
Where it is proved that the Product does not fit the specifications established, LAMU CONCEPT STORE will proceed, where appropriate, to repair or replace the Product, reduce the Product price or cancel the contract for its purchase; such arrangements will have no cost for the User.
LAMU CONCEPT STORE is not liable for any damage to the Products that may result from their improper use or from the User’s acts or omissions which do not comply with the specifications of each Product, or for damage caused by third parties without any connection to LAMU CONCEPT STORE.
LAMU CONCEPT STORE takes the utmost care in presenting and describing the Products. Nevertheless, Product photographs are for illustrative purposes only. To find out the precise features of each Product, Users must check the corresponding descriptive details that accompany each Product.
DISCLAIMER
LAMU CONCEPT STORE has made an effort to show the colors of the articles as close to reality as possible. However, the color of the items that appear on the screen may be subject to variations, depending on the quality of your computer monitor. In this case, LAMU CONCEPT STORE cannot guarantee that the colors that appear on your computer are faithful to reality.
LAMU CONCEPT STORE cannot guarantee that all the products are exactly the same as the ones shown in the picture due to their handmade nature.
- Product Price
The applicable prices for each Product shall be the ones published on the Website on the date the User places the Order. While LAMU CONCEPT STORE does its utmost to ensure that all prices on the Website are correct, mistakes may occur. Where LAMU CONCEPT STORE discovers a mistake in the prices of one of the Products that a User has requested, it will inform that User as soon as possible and give them the option of reconfirming the Order at the correct price or cancel it. Where LAMU CONCEPT STORE is unable to contact the User, the Order will be deemed to be cancelled and the User will be fully refunded for the amounts they have paid.
LAMU CONCEPT STORE is not under any legal obligation to provide the User with any Product at a price below the correct one (even where the Shipment Confirmation has been sent) should the mistake in the price be obvious and unequivocal and the User could have reasonably expected to recognise it as an incorrect price.
Prices may change at any time. Even so, possible changes will not affect the Products that LAMU CONCEPT STORE has already sent Shipment Confirmations for.
The prices on this website are in euros and include VAT. In accordance with the Law on Value Added Tax, LAMU CONCEPT STORE is obliged to charge this tax, at the current rate at all times, to all products delivered in Spain, except the Canary Islands, Ceuta and Melilla.
For deliveries made in the Canary Islands, Ceuta and Melilla, the corresponding taxes and excise duties will be applied in accordance with the regulations in force in each of these territories and that the customer must settle at AEAT customs if required by the AEAT.
Customs expenses will always be borne by the client. For intra-community purchases, those customers who are reliably registered in the Register of Intra-community Operators will be exempt from the tax.
- Payment methods
Users may pay by a Visa, Visa Electron, Mastercard or American Express credit or debit card or through PayPal. For the purposes of minimising the risk of unauthorised access, the User’s credit card details will be encoded. Whether the payment method is by credit or debit card or through PayPal, payment will be made as soon as LAMU CONCEPT STORE sends the User the Shipment Confirmation.
- Chargeback
Where chargeback occurs, under no circumstances shall LAMU CONCEPT STORE bear the costs arising from that refund. The User accordingly declares that they shall bear those costs or penalties.
